Agreement to These Terms

These terms constitute a binding agreement between you (“you”, “the customer”) and Pawan Gold (“we”, “us”, “our”), a business engaged in the production and sale of premium Kachi Ghani mustard oil, operating from Village Khanipur, Post Udaipur, District Pratapgarh, Uttar Pradesh – 230125, India.

They should be read alongside our Privacy Policy, Shipping Policy and Return & Refund Policy, each of which forms part of this agreement.

Who may order

You may place an order only if you are at least eighteen years of age and competent to enter into a contract under the Indian Contract Act, 1872. If you are ordering on behalf of a business, you confirm that you are authorised to bind it.

If you do not agree

If any part of these terms is unacceptable to you, please do not use the website or place an order. Continued use is taken as acceptance.

Product Information

We sell one thing, and we try to sell it honestly: cold-pressed Kachi Ghani mustard oil, extracted at low temperature in a traditional wooden press, filtered and bottled without refining, bleaching or deodorising.

Natural variation

Mustard is an agricultural product. The colour, aroma, pungency and viscosity of the oil vary gently from season to season and from pressing to pressing, according to the seed, the soil and the weather it grew in. A faint natural sediment may settle at the bottom of the bottle over time. None of this indicates a fault — it is precisely what an unrefined oil is expected to do.

Descriptions and imagery

We describe our products as accurately as we are able. Photography is styled to represent the product faithfully, though colour may appear differently depending on your screen. Weights, volumes and packaging specifications are stated on each product page and on the label.

Compliance and storage

• Our products are manufactured, packed and labelled in accordance with applicable food safety standards and the requirements of the Food Safety and Standards Authority of India.
• Every bottle carries a batch number, date of manufacture, best-before date and net quantity. Please check these on arrival.
• Store in a cool, dry place away from direct sunlight, with the cap firmly closed. Storage conditions after delivery are the customer’s responsibility.

Any information on our website concerning the traditional or nutritional properties of mustard oil is offered for general interest only. It is not medical advice, and it is not intended to diagnose, treat, cure or prevent any condition. If you have an allergy, a medical condition or a specific dietary requirement, please consult a qualified professional before use.

Availability

Our pressings are seasonal and our volumes are limited by design. Products are offered subject to availability, and we may withdraw, limit or discontinue an item at any time without notice.

Pricing

• All prices are listed in Indian Rupees (INR ₹) and are inclusive of applicable taxes unless stated otherwise on the product page.
• Delivery charges, where applicable, are calculated and displayed at checkout before payment is made. There are no charges added after that point.
• We may revise prices at any time to reflect the cost of seed, packaging, freight or compliance. Any revision applies to orders placed after the change; it does not affect an order already confirmed.
• Promotional pricing, discount codes and bundle offers are valid only for the period and on the conditions stated, cannot be combined unless expressly permitted, and hold no cash value.

If a price is displayed in error

Despite reasonable care, an occasional error in price or description is possible. Where an obvious error is identified before dispatch, we will contact you, explain what happened and offer you the choice of confirming the order at the corrected price or cancelling it for a full refund. We will never simply charge you the higher amount without asking.

Placing an Order

Placing an order on pawangold.com is an offer to purchase, not a concluded sale.

1. You place the orderSelect your products, enter accurate delivery and contact details, and complete payment.
2. We acknowledge itAn automatic email or message confirms that we have received your order. This is an acknowledgement, not an acceptance.
3. We accept itThe contract between us comes into existence only when your order is dispatched and a tracking reference is shared with you.

When we may decline an order

We reserve the right to refuse, cancel or limit any order, in whole or in part, without being obliged to give a reason. Circumstances in which we ordinarily would include:

• The product is out of stock or the batch has been withdrawn.
• The delivery address is incomplete, unserviceable or evidently incorrect.
• The order appears fraudulent, or payment cannot be verified.
• A pricing or listing error has occurred.
• Quantities suggest resale where the order was placed for personal consumption, or a customer has a history of unfounded claims.

Where an order is cancelled by us after payment, the full amount is refunded to the original payment method.

Payments

Payment is taken through secure, RBI-authorised payment gateways. Depending on what is enabled at the time of your order, this may include UPI, debit and credit cards, net banking and recognised wallets.

• Orders are processed only after successful payment confirmation. Until the gateway confirms the transaction, the order is not queued for packing.
• Your card and banking credentials are captured directly by the payment provider on their secure infrastructure. We neither see nor store them.
• If an amount is debited but the order does not appear, it is ordinarily a settlement delay. Such amounts are typically reversed by the bank within five to seven business days. Write to us with the transaction reference and we will follow it up alongside you.
• Any bank charge, currency conversion fee or transaction levy imposed by your issuer is payable by you.
• Where Cash on Delivery is offered on a given pin code, a nominal handling fee may apply and will be displayed at checkout. Refusal to accept a COD consignment on delivery may result in COD being withdrawn for future orders.

Shipping & Delivery

Orders are processed after successful payment confirmation and are ordinarily dispatched within one to two business days. Standard delivery across India takes five to seven business days from dispatch, with longer timelines for remote, hill, island and restricted-access locations.

Tracking details are shared as soon as the consignment leaves us. Delivery timelines are estimates offered in good faith and are not guaranteed dates, as the final leg is carried out by third-party courier partners.

Risk and title

Ownership of and risk in the products pass to you upon delivery to the address specified in your order, or upon delivery to any person present at that address who accepts the consignment on your behalf.

Cancellations, Replacements & Refunds

Because mustard oil is a sealed food product, we do not accept returns of opened or used items, and we do not offer exchanges under normal circumstances. This is a matter of hygiene and food safety, not of convenience.

A free replacement is offered where the product delivered is the wrong item, is damaged in transit, or is expired on delivery — provided the claim is raised within 48 hours of delivery with clear supporting photographs or video.

Intellectual Property

Everything you see on pawangold.com is our work or is licensed to us: the name Pawan Gold, our logo and marks, our label and packaging design, our photography and film, our copy, our layout and the underlying code.

• You may view, download and print pages for your own personal, non-commercial reference.
• You may not copy, reproduce, republish, distribute, sell or commercially exploit any part of the site without our prior written permission.
• You may not use our name, marks or imagery in a way that suggests an association, endorsement or partnership that does not exist.
• You may not scrape, mirror or systematically extract content, or use it to train a commercial model, without written consent.

All rights not expressly granted are reserved. We take the protection of our brand seriously and will act to defend it.

Your Responsibilities

In using our website and placing orders with us, you agree to the following:

• To provide accurate, complete and current information — particularly your delivery address and telephone number, on which successful delivery depends.
• To keep any account credentials confidential, and to inform us of unauthorised use.
• Not to use the website for any unlawful purpose, or in a way that could damage, disable or impair it.
• Not to attempt unauthorised access to our systems, or to introduce any virus, bot or malicious code.
• Not to place speculative, fraudulent or automated orders.
• Not to misrepresent a claim, or to submit fabricated or altered evidence when requesting a replacement.
• To ensure the product is suitable for you — checking the label, ingredients and best-before date on arrival.

We may suspend or refuse service to any customer who breaches these obligations.

Reviews & Submitted Content

We welcome honest reviews, photographs and feedback — including the critical kind. It is how we improve.

• By submitting content to us or to our public pages, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with our brand, with attribution where practical.
• You confirm that the content is your own, that it is truthful, and that it does not infringe anyone’s rights.
• We may decline to publish, or may remove, content that is unlawful, defamatory, obscene, misleading, promotional of another business, or unrelated to the product.
• We do not edit reviews to alter their meaning, and we do not delete a review simply because it is unfavourable.

Our website may link to or rely upon services operated by others — payment gateways, courier tracking pages, mapping tools and social platforms. These are provided for your convenience.

We do not control such services, do not endorse their content, and are not responsible for their availability, accuracy, terms or privacy practices. Any dealing you have with a third party is between you and them.

Disclaimers

Our website and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranty that:

• The website will be uninterrupted, timely, error-free or free of harmful components.
• Delivery estimates, being dependent on third-party couriers, will be met in every instance.
• Any information on the site regarding traditional uses or nutritional properties will produce a particular result for you.

Nothing in this section limits our responsibility for the quality, safety and description of the products we actually supply, or affects any right you have under the Consumer Protection Act, 2019 or other applicable law that cannot lawfully be excluded.

Limitation of Liability

To the maximum extent permitted by applicable law:

• Our total liability arising out of or in connection with any order shall not exceed the amount actually paid by you for that order.
• We shall not be liable for indirect, incidental, special or consequential loss, including loss of profit, loss of opportunity, or loss arising from delay in delivery.
• We shall not be liable for any loss arising from misuse of the product, use after the best-before date, improper storage after delivery, or use contrary to the instructions on the label.

Indemnity & Events Beyond Our Control

Indemnity

You agree to indemnify and hold harmless Pawan Gold, its proprietor, employees and partners against any claim, loss, liability or expense (including reasonable legal costs) arising from your breach of these terms, your violation of any law, or your infringement of the rights of a third party.

Force majeure

We are not liable for any failure or delay in performing our obligations where that failure or delay results from events beyond our reasonable control. Such events include, without limitation: acts of God, flood, drought, storm or extreme weather; crop failure; fire or explosion; epidemic or pandemic and any resulting restriction; strike, lockout or industrial action; civil disturbance, riot or war; interruption of transport networks, fuel or power; failure of public or private telecommunication networks; and any act, order or restriction of government or a competent authority.

Where such an event occurs, we will inform you as soon as reasonably practicable and will work with you to agree a revised delivery timeline or, where that is not possible, a refund.

Governing Law & Jurisdiction

These terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of India.

Subject to the clause below, the courts at Pratapgarh, Uttar Pradesh shall have exclusive jurisdiction. Nothing in this clause limits any right you may have to approach a consumer forum having jurisdiction under the Consumer Protection Act, 2019.

Talking first

Before either of us approaches a court, we ask that you write to us and give us a fair opportunity to resolve the matter. In our experience, almost everything can be settled by a considered conversation and a little goodwill on both sides.

Severability & waiver

If any provision of these terms is found to be invalid or unenforceable, that provision shall be severed and the remainder shall continue in full force. A delay or failure by us to enforce any right is not a waiver of that right.

Changes to These Terms

We may update these terms from time to time to reflect changes in our products, our processes or the law. The version published on this page at the moment you place an order is the version that governs that order.

The date of the most recent revision appears at the top of this page. Material changes will be brought to your attention through a notice on the website. Continued use of pawangold.com after a revision constitutes acceptance of the updated terms.
